Welcome to the websites and mobile websites operated by AssuranceAmerica Managing General Agency, LLC (CA d/b/a AssuranceAmerica Managing General Insurance Agency, LLC, License No. 0F49773) (“AAMGA”) and supported by other affiliated entities. AAMGA is part of the AssuranceAmerica family of companies, which includes AssuranceAmerica Group, Inc., AssuranceAmerica Corporation, AssuranceAmerica Insurance Company, InsureMax Insurance Company, AssuranceAmerica Commercial Corporation, Catawba Insurance Company, and Trustway Services, LLC d/b/a AssuranceAmerica Insurance Agency (CA License No. 6005799) (“AAIA”), together with their respective parent companies, subsidiaries, and affiliated entities (collectively, the “AssuranceAmerica Companies,” “Company,” “we,” “our,” or “us”). AssuranceAmerica Insurance Company, InsureMax Insurance Company, and Catawba Insurance Company are referred to in these Terms as the “Affiliated Insurers.” The AssuranceAmerica Companies perform different functions in connection with the Site and the products and services offered through it, as described below.
By accessing or using any website or mobile website operated by or on behalf of the AssuranceAmerica Companies (collectively, the “Site”), you agree to be bound by these Terms of Use (“Terms”) and all applicable laws and regulations. If you do not agree, you should not use the Site. We may update these Terms from time to time. Updated Terms are effective upon posting to the Site, and the Effective Date below will reflect the date of the most recent revision. Your continued use of the Site after updated Terms are posted constitutes acceptance of the revised Terms.

Permitted Use
You may access and use the publicly available portions of the Site for lawful, personal, and non-commercial purposes.
You agree not to:
- Use the Site for any unlawful purpose.
- Attempt to gain unauthorized access to any portion of the Site or related systems.
- Interfere with or disrupt the security or functionality of the Site.
- Use automated technologies including bots, crawlers, scrapers, artificial intelligence tools, or data mining tools to access or collect Site data without our prior written authorization.
- Circumvent rate limits, authentication systems, or security controls.
We reserve the right to suspend or terminate access to the Site if we reasonably believe your use violates these Terms or applicable law.
Insurance Agency and Company Roles
AAMGA provides operational and administrative services for the Affiliated Insurers. AAIA is a licensed insurance agency through which insurance products may be offered and sold. AAIA may offer products issued by Affiliated Insurers and by unaffiliated insurance companies (“Third-Party Insurers”). AAIA does not represent that it offers products from every insurer or compares every insurance product available in the market. One or more AssuranceAmerica Companies may also offer, sell, or provide other products and services, directly or through third parties, subject to applicable product- or service-specific terms.
Neither AAMGA nor AAIA is an insurance company. Insurance coverage is underwritten and issued by the insurer identified in the applicable quote, application, binder, declarations page, or policy and is governed by that insurer’s policy terms. The availability of a Third-Party Insurer’s product through the Site does not make that insurer an AssuranceAmerica Company or an affiliate of an AssuranceAmerica Company.
Products and Services Information Disclaimer
The Site provides information about products and services. Insurance products may be offered through AAIA and issued by Affiliated Insurers or Third-Party Insurers. Unless expressly stated otherwise, quotes, coverage descriptions, premium estimates, product summaries, calculators, and other information provided through the Site are for informational purposes and do not, by themselves, constitute an offer to insure, bind coverage, or create any obligation with respect to any other product or service. Insurance coverage is subject to the underwriting approval of the applicable insurer, satisfaction of all applicable conditions, and issuance of a binder or policy by the applicable insurer or its authorized representative. Other products and services may be offered or provided by an AssuranceAmerica Company or a third party and are subject to any applicable terms and conditions.
Insurance coverage is governed exclusively by the terms, conditions, exclusions, limitations, and endorsements of the applicable policy. In the event of any conflict between information on the Site and the applicable policy, the policy controls. Other products and services are governed by the applicable terms, conditions, and disclosures. Products and services may not be available in all jurisdictions, and eligibility requirements may apply.
Content on the Site is provided for general informational purposes only and does not constitute insurance, legal, financial, or other professional advice. Insurance requirements, coverage options, and regulations vary by state and individual circumstances. Eligibility requirements, terms, exclusions, limits, restrictions, underwriting guidelines, and other product or service conditions may apply. For guidance concerning insurance, contact AAIA or another licensed insurance agent in your state. For other products or services, refer to the applicable provider and product- or service-specific terms.
Accounts and Security
Certain portions of the Site may require account registration. You are responsible for maintaining the confidentiality of your login credentials and for all activities conducted under your account. Authentication methods may include passwords, one-time codes, multi-factor authentication, device authentication, or third-party identity verification tools. You agree to notify us immediately if you suspect unauthorized access to your account.
Electronic Communications
We may communicate with you electronically in connection with your use of the Site, including by email, text message, portal message, or other electronic means, consistent with applicable law and any consent you provide. The electronic delivery of insurance records and notices may be governed by a separate Electronic Business Consent. Marketing calls, text messages, and emails may also be governed by a separate consent. Nothing in these Terms expands any consent beyond the scope stated in the applicable consent.
Digital Monitoring and Tracking Technologies
We and our service providers may use cookies, pixels, web beacons, analytics tools, and session recording, replay, and interaction monitoring technologies to monitor interactions with the Site. These tools may collect information about page views, navigation paths, device characteristics, browser information, and interactions with Site content. We may also record or monitor telephone calls, chats, or other communications for quality assurance, training, fraud prevention, and compliance purposes.

Third-Party Services and Links
The Site may contain links to third-party websites or integrate services provided by third parties, including Third-Party Insurers, providers of other products and services, payment processors, identity verification services, analytics providers, customer support tools, or other service providers. Unless otherwise stated, we do not control and are not responsible for the content, security, availability, products, services, or privacy practices of third parties. Insurance products issued by Third-Party Insurers are governed by the applicable insurer’s policy and other terms. Other third-party products and services are governed by the applicable provider’s terms and disclosures.
Intellectual Property
All content available through the Site, including text, graphics, logos, images, software, and design elements, is owned by or licensed to the AssuranceAmerica Companies and is protected by applicable intellectual property laws. Except as expressly permitted by these Terms, you may not reproduce, distribute, modify, or create derivative works from Site content without prior written consent.
Disclaimer of Warranties
The Site and all content are provided on an “as is” and “as available” basis.
To the fullest extent permitted by law, the AssuranceAmerica Companies disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
Limitation of Liability
To the fullest extent permitted by law, the AssuranceAmerica Companies and their respective parent companies, subsidiaries, affiliated entities, predecessors, successors, assigns, and their respective officers, directors, employees, agents, contractors, and service providers (collectively, the “Company Parties”) shall not be liable for any indirect, incidental, consequential, special, exemplary, or punitive damages arising out of or relating to your use of the Site or products and services provided through the Site.
To the fullest extent permitted by applicable law, the total cumulative liability of the Company Parties for all claims arising out of or relating to the Site, products and services provided by the AssuranceAmerica Companies, or these Terms shall not exceed the greater of 1) the amount paid by you to the Company for the specific product or service giving rise to the claim in the twelve months preceding the event giving rise to the claim; or 2) one hundred U.S. dollars ($100).
Nothing in these Terms limits liability where such limitation is prohibited by law.
Indemnification
You agree to defend, indemnify, and hold harmless the Company Parties from any claims, damages, losses, liabilities, or expenses (including reasonable attorneys’ fees) arising out of or relating to:
- Your use of the Site.
- Your violation of these Terms.
- Your violation of any applicable law.
Dispute Resolution and Arbitration
To the fullest extent permitted by law, you and the AssuranceAmerica Companies agree that any dispute, claim, or controversy arising out of or relating to the Site, products and services provided by the AssuranceAmerica Companies through the Site, or these Terms shall be resolved exclusively through final and binding arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration shall be conducted on an individual basis. Nothing in these Terms modifies any dispute resolution provision contained in an insurance policy or other agreement governing a product or service.
If twenty-five (25) or more similar arbitration demands are filed against the AssuranceAmerica Companies or related parties by the same or coordinated counsel or entities and arise out of the same or substantially similar facts, circumstances, or legal issues, the parties agree that such demands shall be administered in coordinated batches. The arbitration provider may group such demands into batches of up to fifty (50) arbitrations to be resolved in sequential proceedings, with one arbitrator assigned to each batch where appropriate. The resolution of one batch may be used by the parties to facilitate settlement discussions for any remaining claims.
The parties further agree that the arbitration provider may adopt reasonable procedures to efficiently manage such coordinated arbitrations, including adjustments to filing schedules, hearing schedules, and administrative requirements.
Nothing in this provision prevents the parties from engaging in good-faith settlement discussions at any time.
The arbitrator shall have exclusive authority to resolve any dispute relating to the interpretation, applicability, enforceability, or formation of this arbitration provision.
Class actions, consolidated actions, and representative proceedings are not permitted.
You may opt out of arbitration within thirty (30) days of first accepting these Terms by sending written notice to:

Governing Law
These Terms are governed by the laws of the State of Georgia without regard to conflict of law principles.
