This Privacy Notice explains how AssuranceAmerica collects, uses, and discloses personal information in connection with products and services, including insurance products and services, websites and mobile services, communications, claims, marketing, and other business activities. In this Privacy Notice, “AssuranceAmerica,” “we,” “us,” and “our” refer to one or more of the AssuranceAmerica Companies identified below, as applicable to the particular product, service, interaction, or activity.
This Privacy Notice may apply to applicants for insurance, policyholders, insureds, listed drivers, claimants, beneficiaries, purchasers and users of products and services, former customers, website and mobile users, agents, brokers, business contacts, and other individuals about whom personal information may be collected or processed.
The “AssuranceAmerica Companies” include AssuranceAmerica Group, Inc., AssuranceAmerica Corporation, AssuranceAmerica Managing General Agency, LLC (in California, d/b/a AssuranceAmerica Managing General Insurance Agency, LLC - License No. 0F49773) (“AAMGA”), AssuranceAmerica Insurance Company, Catawba Insurance Company, InsureMax Insurance Company, AssuranceAmerica Commercial Corporation, and Trustway Services, LLC d/b/a AssuranceAmerica Insurance Agency (CA License No. 6005799) (“AAIA”) together with their respective parent companies, subsidiaries, and affiliated entities. AssuranceAmerica Insurance Company, Catawba Insurance Company, and InsureMax Insurance Company may be referred to as the “Affiliated Insurers.” The insurer issuing a policy may be identified on the declarations page or other policy documents.
AAMGA may provide operational and administrative services for one or more Affiliated Insurers. AAIA is a licensed insurance agency through which insurance products issued by Affiliated Insurers and unaffiliated insurers may be marketed, offered, or sold. One or more AssuranceAmerica Companies may also market, offer, sell, provide, or facilitate other products and services. An unaffiliated insurer or other product or service provider may provide its own privacy notice describing its information practices. Not every AssuranceAmerica Company may be involved in every transaction or activity, and each entity may collect, use, or disclose personal information as applicable to its role in the relevant product, service, transaction, or interaction.
Certain personal information collected in connection with insurance products or services may be subject to the Gramm-Leach-Bliley Act (“GLBA”), federal or state insurance privacy laws, consumer reporting laws, or other privacy requirements. This Privacy Notice is intended to describe our practices generally and does not modify the terms of any insurance policy or create rights beyond those provided by applicable law.

Information We May Collect
AssuranceAmerica may collect personal information and other information as permitted by applicable law. The categories and examples described in this Privacy Notice are intended to be illustrative and may not apply to every individual, product, service, transaction, or interaction.
Personal information may include identifiers and contact information, such as name, mailing address, email address, telephone number, date of birth, Social Security number, driver’s license number, account or policy identifiers, IP address, device identifiers, and similar information.
Insurance application, rating, and underwriting information may include household and driver information, driving history, motor vehicle records, vehicle information, garaging information, prior insurance, claims history, insurance scores, coverage selections, eligibility information, and other information that may be relevant to quoting, rating, underwriting, issuing, renewing, or servicing insurance.
Policy, financial, and transaction information may include policy and coverage information, premium and billing records, payment information, bank account or payment-card information, transaction history, customer-service records, and information concerning an individual’s transactions with AssuranceAmerica, an affiliate, or a nonaffiliated third party.
Claim and health-related information may include accident information, injuries, medical conditions or treatment, medical bills and records, repair information, photographs, recordings, police reports, witness statements, litigation information, and information concerning other persons involved in an accident, loss, or claim.
Consumer-report and insurance-support information may include motor vehicle reports, claims reports, credit-based insurance scores where permitted, identity-verification information, fraud indicators, public records, and other information obtained from consumer reporting agencies, insurance-support organizations, governmental sources, or similar sources.
Communications and digital information may include call recordings, emails, text messages, chat transcripts, correspondence, device and browser characteristics, operating system, referring pages, pages visited, navigation activity, approximate location, mobile-application activity, interactions with digital forms, and similar information. We may also create or receive inferences, analytics, scores, models, or other information relating to risk, fraud, preferences, interests, behavior, or product or service needs, including insurance needs.
Additional categories of personal information may be collected where permitted by applicable law and reasonably related to a product, service, insurance, business, operational, marketing, or commercial purpose described in this Privacy Notice or otherwise disclosed at or before collection where required.
Sources of Personal Information
Personal information may be collected directly from an individual when the individual requests information or a quote, applies for insurance, purchases, enrolls in, or uses a product or service, purchases or renews a policy, makes a payment, submits or participates in a claim, communicates with a representative, uses a website or mobile application, participates in a promotion, responds to marketing, or otherwise interacts with AssuranceAmerica.
Personal information may also be obtained from insurance agents and agencies, affiliated and unaffiliated insurers, managing general agencies, reinsurers, product and service providers, fulfillment providers, consumer reporting agencies, motor vehicle departments, insurance-support organizations, claims databases, prior insurers, financial institutions, payment processors, identity-verification providers, fraud-prevention services, marketing partners, data providers, analytics providers, technology vendors, service providers, and publicly available sources.
In connection with a claim or potential claim, information may be obtained from policyholders, insureds, claimants, witnesses, passengers, other drivers, law enforcement agencies, courts, attorneys, repair facilities, medical providers, experts, investigators, government agencies, and other persons or organizations with information relating to the accident, loss, injury, damages, coverage, or claim.
How Personal Information May Be Used
AssuranceAmerica may use personal information for purposes related to the functions performed by the relevant entity. These purposes may include marketing, offering, selling, providing, facilitating, administering, or supporting products and services; processing transactions and payments; fulfilling customer requests; and communicating about products and services. For insurance products and services, these purposes may also include providing quotes, evaluating eligibility, rating and underwriting risks, issuing and renewing policies, selecting coverages, administering and servicing policies, processing endorsements, cancellations, reinstatements, and nonrenewals, and collecting premiums.
Personal information may be used to report, investigate, evaluate, administer, adjust, defend, settle, or otherwise handle claims; determine coverage, liability, damages, or benefits; coordinate repairs or medical evaluations; pursue subrogation, recovery, or salvage; prevent or investigate fraud, material misrepresentation, or other unlawful activity; and support litigation, dispute resolution, or legal rights.
Personal information may also be used for customer service, quality assurance, call monitoring, training, security, identity verification, account authentication, auditing, actuarial analysis, research, analytics, product development, business planning, regulatory reporting, compliance, recordkeeping, marketing, advertising, lead generation, offering products or services, evaluating the effectiveness of marketing, and other lawful insurance, operational, administrative, business, or commercial purposes.
How Personal Information May Be Disclosed or Otherwise Made Available
AssuranceAmerica may disclose, share, sell, license, transfer, or otherwise make personal information available to affiliated companies and nonaffiliated third parties as described in this Privacy Notice and as permitted by applicable law. The categories of information, recipients, and purposes involved may differ depending on the entity, product, service, state, transaction, and individual interaction.
Personal information may be disclosed or otherwise made available to product and service providers, fulfillment providers, Affiliated Insurers, unaffiliated insurers, reinsurers, managing general agencies, insurance agencies, agents, brokers, adjusters, appraisers, investigators, insurance-support organizations, consumer reporting agencies, claims databases, and other persons or organizations that may be involved in marketing, offering, selling, providing, facilitating, administering, fulfilling, servicing, or supporting products and services, including quoting, rating, underwriting, issuing, renewing, or replacing insurance products or services.
Personal information may be disclosed or otherwise made available to technology vendors, hosting providers, communications providers, payment processors, financial institutions, customer-service providers, identity-verification providers, fraud-prevention services, analytics providers, marketing and advertising partners, lead-generation partners, data providers, professional advisors, auditors, consultants, and other service providers or business partners.
Information relating to an accident, loss, or claim may be disclosed or otherwise made available to insureds, claimants, witnesses, other insurers, reinsurers, adjusters, appraisers, repair facilities, medical providers, attorneys, experts, investigators, law enforcement agencies, courts, governmental authorities, and other persons or organizations involved in evaluating, administering, defending, resolving, or recovering amounts relating to a claim.
Personal information may be shared among the AssuranceAmerica Companies for operational, administrative, insurance-related, service-related, marketing, advertising, analytics, compliance, legal, or other lawful business or commercial purposes, as applicable to the functions performed by the relevant entities.
Personal information may be disclosed when required or permitted in connection with laws, regulations, licensing requirements, examinations, audits, subpoenas, court orders, litigation, governmental requests, law enforcement investigations, fraud reporting, tax obligations, or the protection of legal rights, property, safety, or security.
Information may also be disclosed, transferred, or otherwise made available in connection with an actual or proposed merger, acquisition, financing, reorganization, sale of assets, transfer of policies or books of business, corporate transaction, bankruptcy, or similar event involving an AssuranceAmerica Company or its assets.
To the extent personal information constitutes nonpublic personal financial information, nonpublic personal health information, consumer-report information, or other information regulated by federal or state insurance, financial, health, or consumer reporting laws, that information may be collected, used, or disclosed as permitted by applicable law. Where applicable law requires an authorization, notice, or opportunity to opt out before a particular disclosure, AssuranceAmerica may provide or obtain the required authorization, notice, or choice.
The examples in this Privacy Notice may not be exhaustive. Subject to applicable law, personal information may be collected for additional disclosed or compatible purposes and may be disclosed or otherwise made available to additional categories of recipients as products, services, technology, legal requirements, and business practices evolve. A revised notice or additional choice may be provided where required by applicable law.
Consumer Reports and Insurance-Support Organizations
AssuranceAmerica may obtain information from consumer reporting agencies and insurance-support organizations, including motor vehicle reports, claims history reports, credit-based insurance scores where permitted, identity-verification reports, and other consumer reports. This information may be used for quoting, rating, underwriting, eligibility, policy issuance or renewal, claims, fraud prevention, account verification, or other purposes permitted by law.
If information from a consumer report contributes to an adverse underwriting or other decision, a separate notice may be provided as required by applicable law. Individuals may also have rights to obtain information from or dispute information with the consumer reporting agency that provided the report. Additional disclosures or authorizations may apply if an investigative consumer report is requested.
Websites, Mobile Applications, and Digital Technologies
When individuals access or interact with our websites, mobile websites, mobile applications, or other digital platforms, information may be collected automatically through cookies, web beacons, pixels, software development kits, analytics tools, advertising technologies, and similar technologies. These technologies may collect IP address, device identifiers, browser type, operating system, referring pages, pages viewed, navigation activity, approximate location, mobile-application activity, and time spent on pages or screens.
We or our service providers may also use session recording, replay, and interaction monitoring technologies that record or analyze interactions with our websites or digital platforms. These technologies may capture information such as mouse movements, click activity, scrolling behavior, page navigation, and interactions with website forms. These tools may be operated by us or by third-party technology vendors acting on our behalf. Such monitoring and recording technologies may be used for fraud prevention, security monitoring, quality assurance, analytics, operational performance, compliance purposes, dispute resolution, and improving the functionality and user experience of our digital platforms. Sensitive fields such as payment information may be masked or excluded from recording where technically configured.
Mobile applications may collect device information, application activity, push-notification information, or location information depending on application functionality, device settings, and permissions. Individuals may be able to manage certain cookies, advertising technologies, application permissions, or device settings through available browser, device, application, or privacy controls.
By accessing or using our websites or digital platforms, you acknowledge and consent to the use of cookies, analytics technologies, and session recording, replay, and interaction monitoring technologies to monitor and analyze interactions with our websites to the extent permitted by applicable law.
SMS Communications and Mobile Information
Personal information collected specifically in connection with an individual’s opt-in to receive SMS or text message communications from the AssuranceAmerica Companies (such as information collected through text message interactions, SMS opt-in confirmations, or SMS communication records) will not be sold, shared, or otherwise disclosed to third parties for their own marketing or promotional purposes. Such SMS-related information may be used and disclosed solely for purposes of providing customer service, facilitating communications, processing transactions, fraud prevention, compliance, and other operational or service-related purposes permitted by applicable law. For clarity, personal information collected through online forms, quote requests, applications, or other website interactions, including telephone numbers and TCPA consent obtained through those interactions, is not considered SMS-collected information and may be used, shared, or sold as otherwise described in this Privacy Notice.
Sale or Sharing of Personal Information
Certain privacy laws define “sell,” “share,” “sale,” and similar terms broadly. Depending on the applicable law, a sale may include disclosing or making personal information available to a third party for monetary or other valuable consideration, and sharing may include disclosing or making personal information available for cross-context behavioral advertising.
Personal information may be sold, shared, licensed, transferred, or otherwise made available to affiliated companies, insurance and other product or service partners, marketing and advertising partners, analytics providers, technology vendors, data partners, lead-generation partners, service providers, or other third parties for product-related, service-related, insurance-related, operational, marketing, advertising, analytics, lead-generation, data-enhancement, product-development, or other lawful business or commercial purposes.
Categories involved may include identifiers, contact information, commercial or transaction information, product or service interests or needs, including insurance interests or needs, internet or electronic network activity, device information, approximate geolocation, inferences, and other categories permitted by applicable law. Not every category may be sold or shared in every circumstance, and not every AssuranceAmerica Company may engage in every activity described.
Where required by applicable law, individuals may have rights to request information about certain practices or to opt out of certain sales, sharing, targeted advertising, profiling, or other processing. Applicable rights and methods for exercising those rights may be described in additional state-specific notices or made available through our websites or other channels.
Privacy Choices and Rights
Depending on applicable law and the nature of the information, individuals may have rights to request access to or information about personal information, request correction or amendment of inaccurate information, request deletion of certain information, obtain a copy of certain information, or exercise choices concerning particular disclosures or uses. These rights may be subject to verification, limitations, exceptions, retention requirements, and other conditions provided by law.
Information collected in connection with a claim, fraud investigation, legal proceeding, anticipated litigation, consumer report, or other regulated activity may be subject to different rights or exceptions. Requests concerning information maintained by a consumer reporting agency may need to be directed to that agency.
Individuals may be able to manage certain communication preferences by following instructions in a communication or contacting us. A marketing preference may not apply to product, service, account, policy, billing, claims, legal, safety, or other nonmarketing communications. Cookie, mobile-application, and digital advertising choices may also be available through browser, device, application, consent-management, or other privacy controls.
Former Customers
This Privacy Notice may continue to apply after an individual’s policy, account, claim, or other relationship with AssuranceAmerica ends. Personal information concerning former customers may be retained, used, disclosed, shared, sold, licensed, transferred, or otherwise processed as described in this Privacy Notice and as permitted by applicable law.
Data Retention
Personal information may be retained for as long as reasonably necessary for the purposes described in this Privacy Notice, including providing or supporting products and services, quoting, underwriting, policy administration, claims, fraud prevention, dispute resolution, legal compliance, regulatory examinations, accounting, insurance recordkeeping, analytics, marketing, or other lawful business purposes. Retention periods may vary based on the type of information, the relevant entity, the relationship, and applicable legal or operational requirements.
Security
AssuranceAmerica may maintain administrative, technical, and physical safeguards designed to protect personal information from unauthorized access, disclosure, alteration, destruction, or misuse. Access may be limited to employees, representatives, service providers, or other persons who may need the information for an authorized purpose. No system, safeguard, or method of transmission can guarantee complete security.
Other Notices and Applicable Law
Additional privacy notices, disclosures, authorizations, or choices may be provided in connection with a particular product, service, state, transaction, consumer report, adverse action, claim, health information, electronic communication, or marketing activity. Those materials may supplement this Privacy Notice and may control with respect to the specific subject matter they address.
If a provision of this Privacy Notice conflicts with applicable law, the applicable law may control. Practices may differ in jurisdictions that provide additional or different privacy rights or restrictions.
Updates to This Privacy Notice
This Privacy Notice may be revised from time to time to reflect changes in law, products, services, technology, corporate structure, information practices, or business operations. An updated version may become effective when posted, provided with policy or other materials, or otherwise made available, subject to any additional notice or choice required by applicable law.
