California Privacy Notice
This California Privacy Notice supplements the AssuranceAmerica Privacy Notice and applies to California residents whose personal information is processed in a context subject to the California Consumer Privacy Act, as amended by the California Privacy Rights Act (collectively, the “CCPA”). AssuranceAmerica does not currently provide insurance quotes or offer or sell insurance products in California. We nevertheless may collect limited personal information when California residents visit our websites, request or use products and services that may be available to them, attempt to access quote services, communicate with us, interact with marketing materials, or otherwise interact with us.
This Notice does not apply to personal information collected in an employment, applicant, or other workforce context, which is addressed in separate notices. If this Notice conflicts with the AssuranceAmerica Privacy Notice, this Notice controls with respect to California residents and personal information subject to the CCPA.
For purposes of this Notice, “AssuranceAmerica,” “we,” “us,” and “our” mean one or more of the applicable AssuranceAmerica Companies. The “AssuranceAmerica Companies” include AssuranceAmerica Group, Inc.; AssuranceAmerica Corporation; AssuranceAmerica Managing General Agency, LLC (in California d/b/a AssuranceAmerica Managing General Insurance Agency, LLC, License No. 0F49773) (“AAMGA”); AssuranceAmerica Insurance Company; InsureMax Insurance Company; Catawba Insurance Company; AssuranceAmerica Commercial Corporation; and Trustway Services, LLC d/b/a AssuranceAmerica Insurance Agency (CA License No. 6005799) (“AAIA”), together with their respective parent companies, subsidiaries, and affiliated entities. AssuranceAmerica Insurance Company, InsureMax Insurance Company, and Catawba Insurance Company are referred to as the “Affiliated Insurers.”
Not every AssuranceAmerica Company participates in every interaction. The AssuranceAmerica Company or Companies that process personal information depend on the interaction, product, or service involved. Certain affiliated companies may operate separate services or platforms governed by their own privacy notices.
AAMGA may provide operational and administrative services for the Affiliated Insurers. AAIA is a licensed insurance agency that may market, offer, or sell products issued by affiliated and unaffiliated insurers where authorized, but AAIA does not currently offer or sell insurance in California. One or more AssuranceAmerica Companies may also market, offer, sell, provide, or facilitate other products and services.
Certain personal information collected in connection with an insurance transaction may be governed by the Gramm-Leach-Bliley Act, the California Insurance Information and Privacy Protection Act, or other financial or insurance privacy laws and may be outside the scope of the CCPA. This Notice applies to personal information that is subject to the CCPA, including applicable nonexempt website and other interaction data.

In the preceding 12 months, we collected the categories identified below to the extent California residents interacted with our websites, products and services, or otherwise with us. Not every category or example was collected about every individual.

We do not collect biometric identifiers such as fingerprints, facial recognition templates, retinal scans, voiceprints, or similar biometric information. We do not use or disclose sensitive personal information for purposes that require a right to limit under the CCPA. If sensitive personal information is provided incidentally, we may use or disclose it only as reasonably necessary for permitted purposes.
Sources of Personal Information
We may collect personal information directly from individuals when they visit our websites, request or use products and services, submit a form, attempt to access quote services, communicate with us, or otherwise interact with AssuranceAmerica.
We may automatically collect information when individuals access or interact with our websites using cookies, pixels, web beacons, analytics technologies, and similar tools.
We or our service providers may use session replay, interaction monitoring, or similar technologies that record or analyze interactions with our websites, such as mouse movements, clicks, scrolling, page navigation, and interactions with website forms.
These technologies may be used for security, fraud prevention, analytics, dispute resolution, compliance, quality assurance, operational performance, and improving website functionality and user experience.
Our websites do not respond to traditional browser “Do Not Track” signals because no uniform standard governs those signals. We do not Sell or Share California residents’ personal information and do not authorize service providers to use it for cross-context behavioral advertising. Service providers may collect information over time about interactions with our websites only to provide services to us, subject to applicable contractual restrictions.
We may also obtain personal information from affiliates, service providers, analytics and technology providers, marketing service providers acting on our behalf, public sources, and other sources permitted by law. Because we do not Sell or Share personal information, an opt-out preference signal does not change our current practices. If our practices change, we will update this Notice and process recognized signals as required by law.
Purposes for Collecting and Processing Personal Information
We may collect, use, process, and disclose personal information for the purposes identified in the table above, including operating and securing our websites, determining whether services are available, responding to inquiries, providing customer service, preventing fraud, conducting analytics, improving products and services, conducting our own marketing, complying with legal and regulatory obligations, and otherwise operating our businesses as permitted by law. We do not use California residents’ personal information for cross-context behavioral advertising.
Disclosure of Personal Information; No Sale or Sharing
We do not Sell personal information relating to California residents or Share such information for cross-context behavioral advertising, as the terms “Sell” and “Share” are defined by the CCPA.
In the preceding 12 months, we have not Sold or Shared personal information relating to California residents. We do not have actual knowledge that we Sell or Share the personal information of consumers under 16 years of age.
We may disclose personal information to affiliates, service providers, contractors, technology providers, analytics providers, communications providers, marketing service providers acting on our behalf, professional advisors, and government or legal recipients for the purposes described in this Notice and subject to applicable contractual and legal restrictions.
These disclosures are not a Sale or Sharing when made in accordance with the CCPA. Because we do not Sell or Share personal information, we do not provide a “Do Not Sell or Share My Personal Information” link. If our practices change, we will update this Notice and provide applicable rights and choices before beginning such practices.
Our no-Sale and no-Sharing position does not restrict our ability to use personal information for our own marketing or to disclose information to service providers, contractors, or affiliates for permitted business purposes, provided those activities are conducted in accordance with applicable law.
SMS Communications and Mobile Information
Personal information collected specifically in connection with an individual’s opt-in to receive SMS or text message communications from the AssuranceAmerica Companies (such as information collected through text message interactions, SMS opt-in confirmations, or SMS communication records) will not be sold, shared, or otherwise disclosed to third parties for their own marketing or promotional purposes.
Such SMS-related information may be used and disclosed solely for purposes of providing customer service, facilitating communications, processing transactions, fraud prevention, compliance, and other operational or service-related purposes permitted by applicable law.
For clarity, personal information collected through online forms, quote requests, applications, or other website interactions, including telephone numbers and TCPA consent obtained through those interactions, is not considered SMS-collected information and may be used, shared, or sold as otherwise described in this Privacy Notice.
For California residents, the preceding paragraph is subject to this California Privacy Notice. Personal information collected through online forms or other website interactions may be used and disclosed as described in this Notice, but it will not be Sold or Shared as those terms are defined by the CCPA.
California Privacy Rights
Subject to exceptions and limitations under applicable law, California residents may have the right to know and access personal information collected about them, receive information about its sources, purposes, and recipients, obtain a portable copy, request deletion, and request correction of inaccurate personal information. If a business Sells or Shares personal information, residents also have a right to opt out. AssuranceAmerica does not Sell or Share personal information, so no opt-out request is necessary. We also do not use or disclose sensitive personal information for purposes that require a right to limit.
California residents have the right not to receive discriminatory treatment for exercising rights under the CCPA.
Submitting Privacy Requests
California residents may submit privacy rights requests by calling 1-800-450-7857 or emailing legal@aainsco.com. To verify a request to know, access, delete, or correct, we may ask for information reasonably necessary to match the request to information we maintain and to protect against fraudulent requests. We will confirm receipt within 10 business days and generally respond within 45 calendar days, subject to an additional 45-day extension when reasonably necessary and permitted by law.
Authorized agents may submit requests on behalf of California residents where permitted by law. We may require proof of the agent’s authority and may ask the resident to verify their identity or confirm the authorization directly, unless the agent holds a valid power of attorney.
Data Retention
Identifiers, contact records, commercial information, communications, and inferences are retained only while reasonably necessary for the relevant product, service, interaction, customer service, security, legal, dispute-resolution, recordkeeping, and our own marketing purposes. Internet activity and approximate geolocation information are retained under our security and analytics schedules. Actual periods vary based on the nature of the information and interaction, legal and regulatory requirements, contractual obligations, security needs, and the establishment, exercise, or defense of legal claims. We do not retain personal information longer than reasonably necessary for the disclosed purposes.
Updates to This Notice
We may update this Notice from time to time to reflect changes in our practices or applicable law. The Effective Date above identifies the current version. We will provide additional notice of material changes where required by law.
